How is Accident Compensation worked out?
In an accident you may suffer personal injury, or damage to your property. You hear of people being awarded thousands- even millions. But how is accident compensation worked out?
There are two types of accident compensation that are awarded – general and special.
General compensation
General compensation covers the pain and suffering that you have had to put up with because of the accident. So if you are unlucky enough to break your arm, for example, there is a standard range of payments within which your solicitor would be likely to award compensation for such an injury.
The solicitors do not only take into account physical symptoms. They will also consider the effect that the accident has on your life when they calculate compensation. So if you were a keen golfer and have had to stop doing your favourite hobby, there will be an element of compensation for that.
In terms of the evidence that is needed for general compensation, you may already have seen a medical expert in the course of your treatment. However, sometimes further appointments are needed, which Maximum Compensation can arrange free of charge. The doctor will assess your medical condition and give their opinion on how the injury has affected your life.
Special compensation
Special compensation relates to extra costs or losses that have resulted from the personal injury. So more importantly, if your injury has affected your earnings, the person who caused the accident will be made to compensate you for the loss this has caused.
Other out of pocket expenses can be those incurred on a one-off basis. So if you have had to travel to and from medical appointments, or hired a car because the other party smashed into yours, this expenditure can be recovered as part of the accident compensation.
Most cases are settled between the parties. If the person responsible is represented by an insurance company that admits liability everyone involved wants the case sorted as soon as possible. Your lawyer will advise you whether you should consider any offers of settlement, or hold out for something better. There may be several offers made in the course of a claim for personal injury compensation. Indeed, some are settled outside of the courtroom door!
Whatever the amount of accident compensation that is awarded, make sure that you receive all of it. Some firms deduct a “success fee” from the compensation when their client wins the case. Claimants are often surprised and disappointed by this.
However, this is not the case with Maximum Compensation. Maximum Compensation promises you exactly that: the right to receive everything that the losing party pays to you. There are no deductions and no fees to pay.
